Actions by the Trustee ◊ Disputes With Other Creditors

If you are involved in a bankruptcy proceeding, whether a Chapter 7, Chapter 13 or Chapter 11, you may encounter disagreements regarding the discharge of debt or the reorganization of financial obligations that cannot be resolved. You may have an adverse ruling from the bankruptcy court or have the trustee take action contrary to your interests. In all of these situations, the best way to protect your interests may be through litigation. If that is the case, you want an experienced trial lawyer who understands the bankruptcy process.

At the office of Joseph H. Reinhardt, J.D., Attorney at Law, in Boston, I provide over 25 years of experience to people throughout Massachusetts who are involved in bankruptcy litigation. I place a premium on responsiveness and availability. You can call me any time, day or night, with your legal concerns, and I will either take your call or return your message in a timely manner.

My Bankruptcy Litigation Practice

I focus my entire bankruptcy practice on litigation, handling disputes that arise, including challenges to actions taken by a trustee or disagreements with other creditors. As a general rule, I do not represent debtors, creditors committees or other parties in matters where my fees would be paid from the bankruptcy estate. I have, however, recovered fees previously paid to me from the estate of a bankrupt client.

I have represented parties in all different types of bankruptcy filings, including:

  • An equipment manufacturer in a Chapter 11 proceeding, working with outside special counsel to make certain the company's plan dividend proposed to unsecured creditors was consistent with the financial circumstances of the case
  • A defendant in Chapter 7 filing where the bankrupt party sought to discharge a $4.5 million obligation based on a default judgment.

When you hire me to handle bankruptcy litigation, you will get the benefit of my extensive experience. I now focus my bankruptcy practice exclusively on litigation that arises during the process, taking a tactical and strategic approach at all times.
